What information do we collect?
If you visit Lyris.com or Mailshield.com, we may collect two different types of information about you: personally-identifiable and non-personally-identifiable.
We only collect personally-identifiable information if you opt-in and take certain actions on our site:
- If you choose to fill out an online pre-sales contact form, we record your name, company, email address and phone number.
- If you choose to fill out a Lyris survey, we record your contact information (as provided) in addition to your survey responses.
- If you choose to subscribe to one of our company-sponsored email lists, such as "listmanager-announce" or "ListManager Discuss," we record your email address.
- If you open one of our email announcements, we may record that event and/or any URLs you click on within the message. We may also record which pages you visited on our website.
- If you choose to download a copy of our software, we record your name, company, email address, phone number, and the site you visited before Lyris.com or Mailshield.com.
- If you purchase our software, we record your confidential billing information.
- If you choose to submit a "public" tech support question, your name and email address become part of our publicly-available archive of tech support questions and answers.
- If you choose to submit a "private" tech support question, your name and email address are kept confidential in our internal, restricted-access archive of tech support questions and answers.
We request this information so that we can answer your pre-sales questions, inform you of important company or product news, fulfill your orders, and provide ongoing product support. We store this personally-identifiable information on our own secure servers, and we retain it for our permanent company records.
The non-personally-identifiable information we collect is typical of many web logs: browser and processor type, IP address, and the Web site visited before arriving at our site. We may also track the pages visited within our site. We use this information in aggregate to understand our visitors better, and to learn which sections of our site are most and least popular. We store this information on our own secure server for a period of 6 months, after which it is replaced by more recent data.

We record the personally-identifiable and non-personally-identifiable information described above on our own servers and databases. We do not sell, share or rent this information to anyone outside Lyris Technologies, and access to it is restricted to employees of Lyris Technologies who have a specific, job-related need for it. In addition, our servers are protected to attempt to prevent unauthorized access by outsiders.
Prospective customers sometimes ask us for references of existing customers. In such cases, we may contact you for permission to provide your name as a reference. We will not divulge your contact information without first receiving your explicit permission to do so.
Your company name
In order to promote the success of our software in the marketplace, we post a list of selected customers on Lyris.com and Mailshield.com. If you purchase a Lyris Technologies product or service, we may ask your permission to include your company's name on the appropriate Web site. This listing will also include a link to your company's home page, if applicable.
Our Web site currently includes a list of selected Lyris Technologies customers. If you prefer that we do not list your company, please call us at
(800) 768-2929 or send email to webmaster@lyris.com and we will remove your company's name from the site.
List Members and List Administrators
On occasion, we are contacted by people who are subscribed to mailing lists that are run by our customers using Lyris ListManager software, or on lists that we host for our ListHosting customers. These people typically have a question or complaint about the list they are on (for example, how to unsubscribe from it) but have not been able to contact their List Administrator directly.
We may choose to provide these people with the appropriate List Administrator's email address, so that they can resolve their question. We will not, however, divulge any other, confidential contact information that is part of our customer account records. If necessary, we may contact the List Administrator ourselves and pass on the list member's request.
Information for all Lyris Software customers
Our software periodically sends information electronically to Lyris Technologies that is integral to monitoring users' compliance with our License Agreement, and that enables us to assist list members who call us directly with a question or complaint about the list they are on (as described in the List Members and List Administrators section, above). This information does not include list membership, list content, or any security codes.
Information for all Lyris ListHosting customers
If we host your email list(s), you entrust us with your list information, including passwords, list membership and message content. Once we set up your list and it is running smoothly, we will only access your list's administrative interface when you ask a technical question or when we are alerted by the Lyris software of a possible problem.
Please note that we do not sell, rent, or trade your list information to anyone outside Lyris Technologies. Only employees of Lyris Technologies who are responsible for supporting ListHosting customers are granted access to the lists we host. However, we may need to release or transfer data in a few, special circumstances, when:
- We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.
- We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, spamming, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms of service, or as otherwise required by law.
- We must transfer the information, together with Lyris operational assets, to a successor company in the event of a sale, merger, liquidation, dissolution, reorganization or acquisition of Lyris or a Lyris business or business unit.
- If you decide to terminate your hosted list(s), we will erase your list membership once you have settled all outstanding invoices and have secured a copy for yourself. In addition, the servers we use for ListHosting are protected to attempt to prevent unauthorized access by outsiders. If you are interested in adding a secure web interface to the subscribe page of your Lyris ListHosting email list, please contact your Account Representatives to learn more about this extra-cost option.
